MyGearVault Rewards Contest – Official Rules

ELIGIBILITY:
This MyGearVault Rewards Contest (this “Sweepstakes”) is open only to legal residents of the United States and the District of Columbia (void in Puerto Rico, all U.S. territories and possessions and all overseas military installations) who are at least eighteen (18) years of age or older as of the date of entry. All employees of MyGearVault, LLC (“Sponsor”) and its parent company, its subsidiaries and all associated agencies and their respective affiliates, sales representatives, distributors, licensees or agents (all of the foregoing, together with Sponsor collectively, “Sweepstakes Entities”), and their immediate family members (spouse, parent, child, sibling and their respective spouses) and those living in the same household of each (whether legally related or not), are ineligible to enter or win this Sweepstakes. All applicable federal, state and local laws and regulations apply. Void where prohibited by law. Your entry in this Sweepstakes constitutes your full and unconditional acceptance of these “Official Rules”.
SWEEPSTAKES PERIOD:
This Sweepstakes will begin at 12:00 p.m. Eastern Standard Time (“EST”) on May 14, 2018 and end at 12:00 p.m. on December 1, 2018 (the “Sweepstakes Period”).
ENTRY INSTRUCTIONS:
During the Sweepstakes Period, entrants may enter to win using the MyGearVault app. Entrants will be entered into the Sweepstakes each time they share the Rewards Contest Link. Entrants must be the registered user of the MyGearVault app in order to share the Link.
PUBLICITY:
As a condition of entry into this Sweepstakes, except where prohibited by law, each entrant and each potential winner, by accepting the prize grants to Sponsor and Sponsor’s affiliates, legal representatives, assigns and licensees, a perpetual, worldwide, royalty-free license and right to publicize, broadcast, display and/or otherwise use the entrant’s name, city, state and biographical material in any media now known or hereafter devised throughout the world in perpetuity for advertising and publicity purposes, without additional review, compensation, permission or approval.
SELECTION OF SWEEPSTAKES WINNER:
This Sweepstakes shall have six (6) prize winner(s). The winner will be selected in a random drawing held on or before December 31, 2018. The winner will be selected from all eligible entries received during the Sweepstakes Period. The prize winner will be announced in a single post on mygearvault.com within five (5) days of the drawing and will be directed to email support@mygearvault.com. Sponsor will make every effort to email the prize winner, but may not be able to do so depending on the winner’s individual privacy settings. Please check mygearvault.com to see if you have won. The drawing will be conducted by Sponsor and shall be final and binding. At the sole discretion of Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (i) winner’s failure to respond to notification within 48 hours after its transmission; (ii) winner’s failure to provide Sponsor with satisfactory proof of age, identity and residency; (iii) winner’s failure to validly claim the prize within ten (10) days of the notification date; and (iv) any other non-compliance with the Official Rules. In the event of a prize forfeiture, Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner.
PRIZES, APPROXIMATE RETAIL VALUE (“ARV”) & ODDS:
The winners shall receive one of the following prizes: (i) one camera (either Nikon D850 or Canon 5D Mark IV or Sony a7R III) (ARV $3,300.00); (ii) two $250.00 B and H gift cards (ARV $500.00); (iii) one ThinkTank Airport Security Rolling Bag (ARV $425.00); (iv) one ThinkTank Airport International Rolling Bag (ARV $399.00); and (v) one Rode Video Mic Pro+ (ARV $299.00). The approximate retail value of all of the prizes combined is $4923.00. Prizes will be delivered to the winner on or before January 10, 2019. The prizes will not be replaced if lost or stolen, are not redeemable for cash and are not transferable except at Sponsor’s sole discretion. No substitutions allowed. The winner agrees to accept the prizes “as is”, and entrants hereby acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prizes. The winner is solely responsible for reporting and paying any and all applicable taxes. Each prize winner must provide Sponsor with valid proof of identity, residency and age, matching the identity of the entrant, before any prize will be awarded. ODDS OF WINNING WILL DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED DURING THE SWEEPSTAKE PERIOD.
GENERAL RULES:
By entering or participating in this Sweepstakes, entrants agree to be bound by these Official Rules, and by the decisions of Sponsor, which are final and binding in all respects. Sponsor is not responsible for: (i) any incorrect or inaccurate information or technical failures of any kind, (ii) unauthorized human intervention in any part of the entry process or this Sweepstakes; or (iii) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of this Sweepstakes, the processing of entries, or the selection or notification of the winner. Further, if, for any reason, this Sweepstakes is not capable of running as planned for reasons outside the control of Sponsor which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes (or portion thereof), Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes (or portion thereof). In the event of such cancellation, termination, modification or suspension, Sponsor will select a winner from all eligible, non-suspect entries received prior to such action. Sponsor also reserves the right at its sole discretion to disqualify the entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of this Sweepstakes or any website operated by Sweepstakes Entities; (b) using any robotic, macro, automatic, programmed or like entry methods, which will void all such entries; (c) violating these Official Rules; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Should multiple users of the same email account enter the Sweepstakes and a dispute thereafter arises regarding the identity of the entrant, the authorized account holder of said email account at the time of entry will be considered the entrant. “Authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. Sponsor reserves the right to prosecute any fraudulent entries to the fullest extent of the law.
PARTICIPANT OBLIGATIONS:
By participating in this Sweepstakes, you agree to be bound by these Official Rules and the decisions of Sponsor. By entering, entrant agrees: (i) to defend, indemnify, release and hold harmless Sweepstakes Entities from and against any and all losses, demands, damages, rights, claims, actions and liabilities of any kind arising out of or related to (a) entrant’s participation in this Sweepstakes or (b) entrant’s participation in any prize-related activities (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)); (ii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (iii) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (iv) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. The winner assumes all liability for any injury, death, or damage caused, or allegedly caused, by participating in this Sweepstakes or use or redemption of the prize. Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of New Jersey without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be had in the state and federal courts of the State of New Jersey.

To obtain a copy of these Official Rules or for notification of the winner, contact support@mygearvault.com. Requests for winner lists must be received no later than three (3) months after the end of the Sweepstakes Period.
